WASTE MANAGEMENT LICENCE

31-Oct-97 ABLE received its Waste management Licence from the Environment Agency
18-Jun-99 ABLE received a modification to its Waste management Licence at TERRC from the Environment Agency
21-Oct-02 ABLE received a modification to its Waste management Licence at TERRC from the Environment Agency. The modification was issued to allow TERRC to receive additional types of wastes into the site such as drilling muds and dredging spoils.
30-Sep-03 ABLE received a modification to its Waste management Licence at TERRC from the Environment Agency to increase the permitted tonnages from 24,500 tonnes to 200,000 tonnes per year. The modification also confirmed, for the avoidance of doubt, that ships could be brought into the site under the existing licence.
30-Oct-03 ABLE received a visit from the Environment Agency who verbally requested that ABLE turn the ships around and send them back to the US. At that time, the first tow with two ships was already more than half way to TERRC. ABLE asked for clarification in writing. (This was not received).
12-Nov-03

ABLE received a modification from the Environment Agency. The Environment Agency used their emergency powers to issue the modification stating that additional pollution control measures such as an oil prevention boom would need to be installed. ABLE are appealing this decision as most of the conditions imposed by the modification, including the oil prevention boom, were already in place and there was no reason for any concern therefore it did not require the Environment Agency to issue a modification. The mooring of the ships and the remediation works were going to be carried out in accordance with the Licence and Working Plan.

ABLE are applying to the EA for a new Waste Management Application to cover the decommissioning of ships at TERRC.

The Application was submitted May 2004 with a decision on the licence due in November 2006.

TRANS FRONTIER SHIPMENT AUTHORISATION

4-Jun-03 MARAD submitted a TFS Notification Form to the Environment Agency to import the Ships.
19-Jun-03 MARAD issued a signed Contract under Article 6(6) of TFS to the EA.
22-Jul-03 MARAD received authorisation from the EA to import the MARAD ships.
28-Jul-03 MARAD received a Certificate of Satisfaction from the EA.
30-Jul-03 MARAD received agreement from the EA that the importation could proceed.
10-Sep-03 MARAD received acknowledgement that they had received the Pre-notification to import the vessels. The EA confirmed the ships could sail for the UK.
